Constitutional Odyssey

Constitutional Odyssey PDF Author: Peter H. Russell
Publisher: University of Toronto Press
ISBN: 1442690488
Category : Political Science
Languages : en
Pages : 377

Book Description
Constitutional Odyssey is an account of the politics of making and changing Canada's constitution from Confederation to the present day. Peter H. Russell frames his analysis around two contrasting constitutional philosophies – Edmund Burke's conception of the constitution as a set of laws and practices incrementally adapting to changing needs and societal differences, and John Locke's ideal of a Constitution as a single document expressing the will of a sovereign people as to how they are to be governed. The first and second editions of Constitutional Odyssey, published in 1992 and 1993 respectively, received wide-ranging praise for their ability to inform the public debate. This third edition continues in that tradition. Russell adds a new preface, and a new chapter on constitutional politics since the defeat of the Charlottetown Accord in 1993. He also looks at the 1995 Quebec Referendum and its fallout, the federal Clarity Act, Quebec's Self-Determination Act, the Agreement on Internal Trade, the Social Union Framework Agreement and the Council of the Federation, progress in Aboriginal self-determination such as Nunavut and the Nisga'a Agreement, and the movement to reduce the democratic deficit in parliamentary government. Comprehensive and eminently readable, Constitutional Odyssey is as important as ever.

The Challenge of Direct Democracy

The Challenge of Direct Democracy PDF Author: Richard Johnston
Publisher: McGill-Queen's Press - MQUP
ISBN: 9780773515055
Category : Political Science
Languages : en
Pages : 358

Book Description
In October 1992 Canada's political leaders asked voters to accept the Charlottetown Accord, a comprehensive package of constitutional amendments that was the product of years of negotiation, consultation, and compromise. Canadians rejected it outright, effectively halting the country's formal constitutional evolution. But what did the No vote mean? Were voters making a considered judgment after thorough consideration of the package or were they expressing their anger with politicians, particularly Prime Minister Brian Mulroney? The Challenge of Direct Democracy provides the definitive account of the 1992 referendum on the Charlottetown Accord.

Citizenship Law in Africa

Citizenship Law in Africa PDF Author: Bronwen Manby
Publisher: African Minds
ISBN: 1936133296
Category : Law
Languages : en
Pages : 121

Book Description
Few African countries provide for an explicit right to a nationality. Laws and practices governing citizenship leave hundreds of thousands of people in Africa without a country to which they belong. Statelessness and discriminatory citizenship practices underlie and exacerbate tensions in many regions of the continent, according to this report by the Open Society Institute. Citizenship Law in Africa is a comparative study by the Open Society Justice Initiative and Africa Governance Monitoring and Advocacy Project. It describes the often arbitrary, discriminatory, and contradictory citizenship laws that exist from state to state, and recommends ways that African countries can bring their citizenship laws in line with international legal norms. The report covers topics such as citizenship by descent, citizenship by naturalization, gender discrimination in citizenship law, dual citizenship, and the right to identity documents and passports. It describes how stateless Africans are systematically exposed to human rights abuses: they can neither vote nor stand for public office; they cannot enroll their children in school, travel freely, or own property; they cannot work for the government.--Publisher description.

Book Description
Electoral law, like all other fields of law, Is effective only if it provides for sanctions. The cancellation of elections results, The most serious of sanctions, Is in general linked To The most serious of irregularities, especially when its effects are felt beyond a small constituency. However, small technical inaccuracies may affect election results if the difference in votes is minimal, As recent examples such as the notorious 2000 United States presidential elections have shown. This book aims to determine when electoral disputes should lead to such a consequence, based on the practice of national, constitutional and supreme courts throughout Europe, As well as on the practice of the European Court of Human Rights.
