A Practical Approach to Animal Welfare Law

A Practical Approach to Animal Welfare Law PDF Author: Noel Sweeney
Publisher: 5m Books Ltd
ISBN: 1912178605
Category : Law
Languages : en
Pages : 244

Book Description
Historically animal law has been a piecemeal legislative process of amendments and repeals. The slow progress of the legislation has finally resulted in the introduction of the two main criminal statutes affecting animals, the Animal Welfare Act 2006 and the Dangerous Dogs Act 1991. These two statutes account for almost all offences of animal abuse in every conceivable form relating to the duty of owners and their concurrent liability and responsibility. A Practical Approach to Animal Welfare Law is designed to be informative and interesting to a broad, lay audience. It covers all aspects of those two Acts as they affect animals in our care. This book analyses the law relating to the criminal responsibility of owners and their duty of care for the welfare of their animals including injuring and killing them. The prosecution of offenders is investigated through the enforcement powers of the inspectors and the consequent sentencing by the courts. In doing so it deals with all manner of animal abuse as well as dangerous dogs and dangerous people. The relevance of each Act to the various authorities is analysed, providing a practical guide for people involved in various everyday activities with animals and their behaviour. This book is an essential reference source for those whose work involves animal law – including academics, legal practitioners, local authorities and the police. Equally it will be a valuable source for those working in animal related areas such as breeding, exhibitions and the rights and welfare of animals by charitable organisations and sanctuaries. A Practical Approach to Animal Welfare Law concludes with an analysis of the role and status of animals in English Law. There is a unique discussion on reform and the future of animal welfare and animal rights. That analysis applies to many jurisdictions on a national and international level, particularly in relation to common law countries. This is no staid law book. The warmth and compassion of the author shines through the text, as he engages the reader in this difficult subject through case reports, stories, examples, analysis and discussion. Creating an exceedingly useful, insightful and interesting resource for a broad range of animal experts, workers and owners. 5m Books

Animal Rights Without Liberation

Animal Rights Without Liberation PDF Author: Alasdair Cochrane
Publisher: Columbia University Press
ISBN: 0231158262
Category : Nature
Languages : en
Pages : 257

Book Description
Alasdair Cochrane introduces an entirely new theory of animal rights grounded in their interests as sentient beings. He then applies this theory to different and underexplored policy areas, such as genetic engineering, pet-keeping, indigenous hunting, and religious slaughter. In contrast to other proponents of animal rights, Cochrane claims that because most sentient animals are not autonomous agents, they have no intrinsic interest in liberty. As such, he argues that our obligations to animals lie in ending practices that cause their suffering and death and do not require the liberation of animals. Cochrane's "interest-based rights approach" weighs the interests of animals to determine which is sufficient to impose strict duties on humans. In so doing, Cochrane acknowledges that sentient animals have a clear and discernable right not to be made to suffer and not to be killed, but he argues that they do not have a prima facie right to liberty. Because most animals possess no interest in leading freely chosen lives, humans have no moral obligation to liberate them. Moving beyond theory to the practical aspects of applied ethics, this pragmatic volume provides much-needed perspective on the realities and responsibilities of the human-animal relationship.

Model Animal Welfare Act

Model Animal Welfare Act PDF Author: Janice Cox
Publisher:
ISBN: 9780692803158
Category :
Languages : en
Pages : 129

Book Description
This Model Animal Welfare Act has been designed to serve as a basic template and guidance document for those interested in enacting new legislation or improving existing animal protection legislation. It has been drafted using an extensive comparative law exercise, taking into account 'best practice' in the field. Thus it is aspirational in nature; seeking to provide the best possible structures, systems and provisions to protect the welfare of animals. This may mean that countries which are just starting to establish animal welfare requirements might decide to introduce its provisions progressively. In such cases, a strategic approach (step-wise and prioritised) is recommended. This could also be considered in cases where countries already have structures, systems and provisions that have been introduced gradually over time, but remain less than optimal. The important principle is that each country works progressively towards the best possible protection for the welfare of its animal population, and indeed - as elaborated in the Three Rs approach - the eventual reduction and replacement of any uses of animals which compromise their welfare. The purpose of this Model Animal Welfare Act is to function as an 'umbrella' or 'framework' law. It represents an international unification and harmonisation of animal protection and welfare legislation, which can be adapted or modified - if the circumstances require - in Common Law as well as Civil Law systems. Elements of both legal orders have been considered and incorporated to achieve (as far as possible for the present day) a comprehensive, far-reaching and progressive approach to animal welfare legislation which takes account of the desired expedience when it comes to prevention of animal cruelty and abuse, establishing responsibility and the principle of care towards the animal, promoting the education and sensitisation of the population, as well as offering effective solutions for efficient law enforcement. This Model Act was created in order to govern people's behaviour, while other civil or religious legal systems may take a very different form (for example, be limited to 'codes' or 'edicts'). Nonetheless, elements of this Act can also be used for inspiration in creating, amending or interpreting these.

Animals, Welfare and the Law

Animals, Welfare and the Law PDF Author: Ian A. Robertson
Publisher: Routledge
ISBN: 1136281916
Category : Law
Languages : en
Pages : 277

Book Description
In this objective, practical and authoritative introductory text the author reveals how the fundamental principles of the human-animal relationship drive the development of animal law. The book explains the criteria by which the lawful use of animals is determined, and how these criteria impact evolving standards of animal protection and define the responsibilities of people in their interactions with animals. The author identifies 29 key principles which constitute the core knowledge necessary for people involved in debating, assessing, and guiding the evolution of society’s national and international rulebook of animal welfare law. The book also considers animal welfare and law in the context of a global market through discussion of common issues such as climate change, biosecurity, food safety and food supply. Based on successful law courses run by the author and his own expertise as an animal law lecturer, prosecutor and specialist legal adviser, the book combines insights from science, ethics and law to provide an essential understanding of what informs society and the law with regards to animals and their welfare.
