This short article sets out A Twelve Point Plan for Labour, after a review of the pathbreaking Manifesto for Labour Law, written by a host of the most distinguished labour lawyers from Britain, Europe and the Commonwealth. The essence, which became official policy at the Labour Party Conference of 2016, is a call for sectoral collective bargaining, a matching right to collective action, a meaningful floor of rights fully enforced, a renewed Ministry of Labour and an autonomous appellate Labour Court. Building on this, 'A Twelve Point Plan', with aims increasingly shared across the international labour movement, is set forth. Ten (save F and L) can be won through collective bargaining right now, to renew democracy and social justice. 1. Automatic enrolment and all-out recruitment to trade unions. 2. Board representation by votes at work. 3. Councils at work elected with binding rights. 4. Dismissals must be deferrable by work councils. 5. Extension of collective agreements. 6. Full employment through fiscal, monetary and trade policy. 7. Gender and general equality. 8. Holidays progressively raised to half the year. 9. Investment funds for income insurance. 10. Jobholders must have all rights. 11. Knowledge economics: a right to education at work. 12. Labour Courts, Labour Ministry and Legislature reform.

Labour law is widely considered to be in crisis by scholars of the field. This crisis has an obvious external dimension - labour law is attacked for impeding efficiency, flexibility, and development; vilified for reducing employment and for favouring already well placed employees over less fortunate ones; and discredited for failing to cover the most vulnerable workers and workers in the "informal sector". These are just some of the external challenges to labour law. There is also an internal challenge, as labour lawyers themselves increasingly question whether their discipline is conceptually coherent, relevant to the new empirical realities of the world of work, and normatively salient in the world as we now know it. This book responds to such fundamental challenges by asking the most fundamental questions: What is labour law for? How can it be justified? And what are the normative premises on which reforms should be based? There has been growing interest in such questions in recent years. In this volume the contributors seek to take this body of scholarship seriously and also to move it forward. Organizing Matters demonstrates the interplay between two distinct logics of labour’s collective action: on the one hand, workers coming together, usually at their place of work, entrusting the union to represent their interests and, on the other hand, social bargaining in which the trade union constructs labour’s interests from the top down. « The book presents the findings of a four-year study of the challenges facing trade unions and their responses in ten west European countries. The project involved a substantial number of interviews with key union representatives and academic experts in each country, together with the collection of a large amount of union documentation and background material. The book gives an account of trade unionism in each country, the main recent challenges that unions have faced, and responses in terms of recruitment and mobilisation; organizational restructuring; new approaches to collective bargaining; changing political strategies; and international activities. The analytical starting point is that trade unions are conservative institutions containing significant veto points to organizational change, but at the same time can display dynamism and innovation, and that external challenges can therefore stimulate important internal adaptation. The book engages with the debates of the past two decades on union modernization and revitalization, and more generally with theories of institutional change and with the literature on varieties of capitalism. The central theme is that while trade unions do not easily change identities and core practices, they are not locked into inertia. Trade unions are not unitary actors but are internally contested organizations, and internal conflict is itself a potential source of dynamism. The literature on "revitalization" has tended to divide between the over-optimistic and the over-pessimistic; this study presents a more nuanced and differentiated account. In particular, it attempts to identify some of the key internal and external conditions for effective strategic innovation. »--
