Essays in the History of Canadian Law

Essays in the History of Canadian Law PDF Author: Christopher English
Publisher: University of Toronto Press
ISBN: 1442658169
Category : Law
Languages : en
Pages : 438

Book Description
The study of Canadian legal history has seen a remarkable growth in the past decade, nowhere more so than in Atlantic Canada. Given its early settlement and some of the liberties taken with legal procedure there - as well as some creative interpretations of English law – the region is ripe for close study in the legal history field. This new collection examines that history on 'two islands:' Newfoundland and Prince Edward Island. The essays examine legal themes, developments, and disputes, and offer a framework for comparing ways of administering justice through the courts in the eighteenth and nineteenth centuries. The cases examined are particularly interesting for the light they throw on legal process and, especially, on the motives of the parties. Unlike in contemporary England and Upper Canada, the English precedents gave way to local needs as equitable regimes emerged that put family and community interests first, and treated all members of the family in ways tailored to their personal needs and circumstances. This volume, which includes a number of essays examining women's legal status and access to the courts, is a comprehensive and fascinating examination of legal history in two Canadian provinces.

Atlantic Canada's Irish Immigrants

Atlantic Canada's Irish Immigrants PDF Author: Lucille H. Campey
Publisher: Dundurn
ISBN: 1459730259
Category : Social Science
Languages : en
Pages : 305

Book Description
A transformative work that explodes assumptions about the importance of the Great Irish Potato Famine to Irish immigration. In this major study, Lucille Campey traces the relocation of around ninety thousand Irish people to their new homes in Atlantic Canada. She shatters the widespread misconception that the exodus was primarily driven by dire events in Ireland. The Irish immigration saga is not solely about what happened during the Great Potato Famine of the 1840s; it began a century earlier. Although they faced great privations and had to overcome many obstacles, the Irish actively sought the better life that Atlantic Canada offered. Far from being helpless exiles lacking in ambition who went lemming-like to wherever they were told to go, the Irish grabbed their opportunities and prospered in their new home. Campey gives these settlers a voice. Using wide-ranging documentary sources, she provides new insights about why the Irish left and considers why they chose their various locations in Nova Scotia, New Brunswick, Prince Edward Island, and Newfoundland. She highlights how, through their skills and energy, they benefitted themselves and contributed much to the development of Atlantic Canada. This is essential reading for anyone wishing to understand the history of the Irish exodus to North America and provides a mine of information useful to family historians.
