Incumbent the Churchwardens should apply to the Chancellor for an instrument of sequestration, and ask the Bishop to appoint a Curate to conduct Divine Service during the vacancy. They will have to account to the incoming Incumbent for the expenditure and receipts of the living during the interval. PARISH OFFICERS. Parish Clerks. 58. --In parishes existing before 1604 the right of Election was in the parishioners, and it is so still where a custom can be shown. But in Churches built under the Church Building Acts (since 1819) the right of nomination has been conferred by statute upon the Incumbent. Generally his office is for life (2 Stra. 706) except as hereinafter mentioned. A mandamus will lie to compel the Incumbent to appoint. See Rex v. St. Ann's, 1766. 3 Burr, 1877. Where no endowment exists, there does not appear to be any salary due to the clerk other than that arising from Fees. This does not apply where any special bargain has been made, nor to modern churches. No one has a right to veto the appointment of a Deputy-clerk, and he would collect the Fees. By 7 & 8 Vic., c. 59, sec. 5, the Archdeacon or other Ordinary may remove a misdemeaning Clerk who is not in holy orders, but a mandamus will lie to restore the Clerk if any injustice has been done by his wrongful suspension or removal from office. It does not appear that the Parish Clerk has a freehold tenure of the office in Churches regulated by 58 Geo. III., c. 45, 59 Geo. III., c. 134, or by 6 & 7 Vic., c. 37, 7 & 8 Vic., c. 94, and 19 & 20 Vic, c. 104. Sextons. 59. --The appointment of Sexton is in the parishioners, except where there is a custom to the contrary. The office is a freehold. If the duties of a Sexton are confined to the Church his appointment is presumably by...
