This book is a collection of contributions by leading scholars on theoretical and contemporary problems of militant democracy. The term 'militant democracy' was first coined in 1937. In a militant democracy preventive measures are aimed, at least in practice, at restricting people who would openly contest and challenge democratic institutions and fundamental preconditions of democracy like secularism - even though such persons act within the existing limits of, and rely on the rights offered by, democracy. In the shadow of the current wars on terrorism, which can also involve rights restrictions, the overlapping though distinct problem of militant democracy seems to be lost, notwithstanding its importance for emerging and established democracies. This volume will be of particular significance outside the German-speaking world, since the bulk of the relevant literature on militant democracy is in the German language. The book is of interest to academics in the field of law, political studies and constitutionalism.

This Article advances a new analytic framework for the Supreme Court of Canada's theory of democracy and the right to vote. After setting forth the Court's general approach to democracy, I argue, first, that the Court has adopted a “bundle of democratic rights” approach to its understanding of the right to vote. By this I mean that the Court has interpreted the right to vote as consisting of multiple democratic rights, each of which is concerned with a particular facet of democratic governance. Second, I claim that the democratic rights recognized by the Court are best understood as “structural rights.” In its law of democracy decisions, the Court is attuned to the structural dimension of democratic rights because it recognizes that an individual's exercise of his or her rights takes place within an existing organization of social and political power. Structural rights theory thus offers a new way to account for the individual and institutional dimension of democratic rights. I argue that the Court's recognition of multiple democratic rights, and its attention to the structural dimension of these rights, has enabled it to regulate the democratic process as a whole. This Article examines how the Court has regulated a wide array of complex issues - such as the structure of representation, electoral redistricting, the role of money in elections, individual participation, political equality, and the regulation of political parties - by using the mechanism of rights. It also shows how many of the internal tensions in the Court's law of democracy decisions have their roots in conflicts among these democratic rights. Instead of suppressing these conflicts, I claim that the Court should render them transparent and provide a justification for the resolution it ultimately reaches. In sum, the Supreme Court's approach to democracy and the right to vote provides a useful paradigm for courts in other jurisdictions that are likewise faced with the complexity of supervising the democratic process.

Although the government of the United States is traditionally viewed as a democracy, there is considerable disagreement about what democracy means and implies. In a comprehensive study Professor Edelman examines the three democratic paradigms most prevalent in America today: natural rights, contract, and competition. Theories based on these paradigms lead to different ideas of democracy, each of which yields variant interpretations of the Constitution. This close relationship between democratic theories and constitutional interpretations is analyzed in an extensive historical introduction, which focuses on some of the major thinkers in American history. Edelman's discussion shows that neither the Constitution nor the development of American political thought can serve as an authoritative basis for any one theory of democracy. Instead of a particular theory, the historical constant was an appeal to reason inherent in our basic charter. In his methodological section, Edelman argues that we must use reason to clarify the latent values inherent in the differing concepts of democracy and the consequences that flow from them. He analyzes judicial ideas in the light of three concepts deemed central to any democratic theory—citizenship, political participation, and political freedom—and concludes with a balanced account of contemporary democratic theories, the constitutional theories related to them, and a critique of both.

The desirability, or lack thereof, of bills of rights has been the focus of some of the most enduring political debates over the last two centuries. Unlike civil and political rights, social rights to the meeting of needs, standardly rights to adequate minimum income, education, housing, andhealth care are not usually given constitutional protection. This book argues that social rights should be constitutionalized and protected by the courts, and examines when such constitutionalization conflicts with democracy. It is thus located at the crossroads of two major issues of contemporarypolitical philosophy, to wit, the issue of democracy and the issue of distributie justice. Interestingly and surprisingly enough, philosophers who engage in penetrating discussions on distributive justice do not usually reflect on the implications of their argument for democracy; they are met withequal indifference on the part of theorists of democracy. This book stems from the perception that there may be conflicts between the demands of democracy and the demands of distributive justice, both of which are crucially important, and from the resulting recognition that the question of therelationship between these two values cannot be ignored.
