Selected Essays on the Conflict of Laws

Selected Essays on the Conflict of Laws PDF Author: Friedrich Juenger
Publisher: BRILL
ISBN: 9004480439
Category : Law
Languages : en
Pages : 457

Book Description
Friedrich K. Juenger on the conflict of laws is always worth attending to. Rejecting the "conventional wisdom" that prevails in the field, he sees the conflict of laws not as a discipline devoid of substantive values but as a powerful catalyst for multistate justice. Here is a wide-ranging collection of essays on a variety of problems posed by transactions that transcend state and national borders. The essays include a comparison of jurisdiction issues in the United States and the European Communities, opinions on forum shopping, a critique of interest analysis techniques, and a plea for a comparative approach to choice-of-law issues. Invaluable studies in the extraterritorial application of United States antitrust law, recognition of foreign money judgments and divorces, and regional conventions round out the collection. Published under the Transnational Publishers imprint.

The Vinson Court

The Vinson Court PDF Author: Michal R. Belknap
Publisher: Bloomsbury Publishing USA
ISBN: 185109542X
Category : Law
Languages : en
Pages : 305

Book Description
Spanning the years from 1946 until 1953, the Vinson Court made the legal transition from World War II to the Korean War, and the outspoken justices Felix Frankfurter and Hugo Black helped shape its legacy. The Vinson Court summons students and legal professionals to understand the impact and tensions of Fred Vinson's term as Chief Justice from 1946–1953. Court scholar Michal R. Belknap explores McCarthyism, the Cold War, racial segregation, and capital punishment from the Supreme Court's view. These controversies shaped the most important decision on presidential powers, restrictions on political expression, and a nasty conflict over the Rosenbergs. Significant rulings are reviewed, and the 12 justices on the Vinson Court including Felix Frankfurter and Hugo Black are introduced. Clashes were common between some of the Supreme Court's strongest personalities, and these are highlighted throughout the text. The court's legacy completes this powerful study of constitutional law.

Essays on the Patriarchal Narratives

Essays on the Patriarchal Narratives PDF Author: A. R Millard
Publisher: Wipf and Stock Publishers
ISBN: 1725221543
Category : Religion
Languages : en
Pages : 250

Book Description
Today, there is renewed interest in the history and traditions of the patriarchal period. Recent publications have sought, among other things, to show that the biblical patriarchs were a literary, even fictional, creation of the first millennium BC, produced to provide the nation of Israel, which came into prominence only then, with "founding fathers." Much of this new writing is helpful in distinguishing what are traditional or speculative interpretations from the basic texts of Genesis. Sometimes archaeological evidence has been adducted in support of the historicity of the patriarchs and their cultural background in the second millennium BC which can no longer be sustained. Sometimes, however, the value of such evidence is ignored or belittled. -- from the preface

Inside the Pentagon Papers

Book Description
Inside the Pentagon Papers addresses legal and moral issues that resonate today as debates continue over government secrecy and democracy's requisite demand for truthfully informed citizens. In the process, it also shows how a closer study of this signal event can illuminate questions of government responsibility in any era. When Daniel Ellsberg leaked a secret government study about the Vietnam War to the press in 1971, he set off a chain of events that culminated in one of the most important First Amendment decisions in American legal history. That affair is now part of history, but the story behind the case has much to tell us about government secrecy and the public's right to know. Commissioned by Secretary of Defense Robert McNamara, the Pentagon Papers were assembled by a team of analysts who investigated every aspect of the war. Ellsberg, a member of the team, was horrified by the government's public lies about the war - discrepancies with reality that were revealed by the report's secret findings. His leak of the report to the New York Times and Washington Post triggered the Nixon administration's heavy-handed attempt to halt publication of their stories, which in turn le
